Federal court overturns California's open carry ban for most of state

The Ninth Circuit Court of Appeals has ordered an en banc rehearing of the case challenging California's ammunition background check law (Rhode v. Bonta), which restores the law's enforcement for the time being. A three-judge panel had previously ruled the law unconstitutional in July 2025, but that decision is now vacated pending a review by a larger, 11-judge panel.
Current Status of the Law
Law is in effect: California's requirements for background checks on ammunition purchases currently remain in effect and must be followed by dealers and buyers until further notice.
Previous ruling vacated: The three-judge panel's July 2025 opinion, which had struck down the law as unconstitutional under the Second Amendment, has been vacated by the order for an en banc review.
Future proceedings: Oral arguments for the full 9th Circuit panel rehearing are scheduled for the week of March 23, 2026.
