The U.S. Supreme Court just handed concealed carry permit holders a major victory, and the decision could have a direct impact on Maryland.

In a 6 to 3 decision, the Court struck down Hawaii’s law that made it a crime for a lawful concealed carry permit holder to carry a firearm onto private property that is open to the public unless the business owner gave express permission first.

Think about what that meant.

A permit holder could walk into a grocery store, pharmacy, gas station, restaurant, or retail store and unknowingly commit a crime simply because the owner had not affirmatively said fi****ms were allowed.

The Supreme Court said that flips the Constitution on its head.

The Court made it clear that private property owners absolutely have the right to prohibit fi****ms on their property. If a business wants to ban fi****ms, it can post signs or otherwise tell customers they are not permitted.

What a state cannot do is presume every business is gun free unless the owner first gives permission.

Why does this matter in Maryland?

Because Maryland passed Senate Bill 1 after the Supreme Court’s Bruen decision, and it contains nearly the same provision Hawaii was defending.

Maryland generally prohibits permit holders from carrying fi****ms onto most private property open to the public unless the owner has expressly permitted it.

Today’s ruling calls that provision into serious constitutional question.

The decision does not eliminate every restriction in Maryland’s gun laws. Sensitive places, like schools and certain government buildings, are governed by separate legal issues that were not decided in this case.

But the Supreme Court has now said states cannot make “no guns” the default rule for every private business open to the public.
