The injunction on the challenged h**p rules has officially been reinstated, which means those restrictions are currently paused again. This allows h**p-derived products, including flower, to continue being sold while the legal process moves forward.

The State of Texas has until next Thursday to respond. Until then, the injunction remains in effect, and operations can continue under the previous framework. This is a temporary window, and the outcome after this deadline will determine what happens next.

We are closely monitoring the situation and will continue to keep you informed as updates come in. As always, we remain committed to operating transparently and providing compliant, high-quality products to our community.

As per Texas H**p Business Council:
On May 5, 2026, The State appealed the temporary injunction we were granted by the Travis County District Court and Judge Lyttle.

Thus, the injunction is now stayed meaning it has been lifted and is no longer in effect. All rules can now be enforced against. We anticipated the state doing this.

To counteract this action, THBC filed something called a Rule 29.3 with the court of appeals this morning, asking the court to reinstate our temporary injunction while the State’s appeal is pending.

We hope to have a decision by the court by this Friday at the latest and sooner if possible, as the court understands this is an emergency motion and should act quickly (but there is no deadline for them to decide). We anticipate the State filing its response to our motion today or tomorrow morning, at the latest.

Although our attorneys at Butler Snow anticipated this reaction by the State, it doesn’t make it any easier on any members of the industry. We are working as quickly as possible to resolve it.
