Register to Publish ATF 2021R-08F
Two weeks since its Final Ruling was made public, the Federal Register has announced that ATF 2021R-08F, "Factoring Criteria for Fi****ms with Attached Stabilizing Braces," will be published tomorrow, January 31.
As of January 31, pistols equipped with an attached stabilizing brace that meet the criteria of the rulemaking will effectively be re-classified as Short Barreled Rifles (SBRs). There are a variety of options for affected individuals and entities in possession of such fi****ms. Options include, but are not limited to:
Register the firearm(s) in your possession as an SBR. Individuals and entities that lack Special Occupational Taxpayer status may file a Form 1 tax free for 120 days (May 31, 2023).All standard NFA rules will apply to the firearm(s) following such registration.
Remove the brace from the firearm without registration.
Add a 16”+ barrel to the firearm to render it a standard GCA item.
Depending upon your particular situation there may be additional options available. Depending upon your particular situation, destruction or sale of your stabilizing brace may be warranted to avoid being in “constructive possession” of an unregistered NFA item.

On January 13, 2023, the Attorney General signed ATF final rule 2021R-08F, “Factoring Criteria for Fi****ms with Attached ‘Stabilizing Braces,’” amending ATF’s regulations to clarify when a rifle is designed, made, and intended to be fired from the shoulder.
