Very exciting news!

Dear NH & AHPA Herbal Tincture Working Group:

We are pleased to provide an exciting update on AHPA’s efforts to secure a permanent legislative solution for the herbal tinctures issue in New Hampshire.

Thanks to the incredible dedication and support of this working group, we are now just one step away from achieving our goal. Your collective action last year was instrumental in capturing the attention of the New Hampshire Liquor Commission (NHLC) and securing crucial access to Senator Reardon. Because of that momentum, we successfully advocated for legislative language, supported by the NHLC, that will permanently protect and codify consumer access to herbal tinctures in the state.

In April, AHPA’s proposed language was formally introduced as an amendment to another active bill. This amendment creates a new section of state law that explicitly exempts alcohol-based herbal tinctures (among other non-beverage products, such as OTC drugs, cosmetics, and flavorings) from liquor controls, permitting their continued sale as dietary supplements in standard retail outlets.

The bill has officially passed both houses and, as of June 10, the final language has been enrolled — meaning the bill has been printed in its final, official form with the exact wording approved by both chambers and signed by legislative leadership, making it ready for the Governor.

The enrolled bill is now headed to the Governor’s desk for her final signature. In New Hampshire, the Governor has five days to sign an enrolled bill, so we expect signing to happen in the coming days. Once signed, the bill becomes law, and the new statute protecting tinctures will officially go into effect in January 2027.

We want to express our deepest gratitude for your patience, advocacy, and continued support throughout this entire process. We could not have reached this major milestone without your contributions.
