WHEN AN ACCUSED PLEADS NOT GUILTY WHATS NEXT?
When an accused person pleads βnot guiltyβ, the case moves into the trial stage.
Hereβs what usually happens next in criminal proceedings:
1. The court records the plea
The judge officially notes that the accused denies the allegation.
2. A trial date is fixed
The court schedules dates for hearing the case.
3. The prosecution presents its case
The prosecution calls witnesses and presents evidence to prove the offence beyond reasonable doubt.
4. Cross-examination begins
The defence lawyer questions the prosecutionβs witnesses to test their credibility and evidence.
5. No-case submission may arise
If the prosecution fails to establish a prima facie case, the defence can ask the court to dismiss the matter.
6. The defence opens its case
If the court finds a case to answer, the accused may:
testify personally,
call witnesses,
or remain silent depending on the circumstances and applicable law.
7.Final written addresses or oral arguments
Both sides summarize their arguments before judgment.
8. Judgment is delivered
The court either:
convicts the accused, or
discharges/acquits the accused.
