Dear Customer
We are writing to provide an update on significant legislative developments that may affect the sale, display and marketing of va**ng products and other ni****ne products in retail stores across Ireland.
Two separate pieces of legislation are currently progressing through the Oireachtas and could result in substantial changes to the regulatory framework governing these products.
Public Health (To***co Products and Ni****ne Inhaling Products) (Amendment) Bill 2026
The Government has approved the publication of the Public Health (To***co Products and Ni****ne Inhaling Products) (Amendment) Bill 2026.
While the Bill has not yet been formally published, the Department of Health has indicated that it may introduce measures including:
● An under-18 sales prohibition for ni****ne pouches
● A full retail display ban for va**ng products and ni****ne pouches in mixed retail outlets
● A ban on in-store advertising and promotion
● Packaging and product design restrictions for va**ng devices
● Potential limitations on v**e flavours to to***co only
The text of the legislation is expected to be published in the coming weeks and will then progress through the standard legislative process in both Houses of the Oireachtas (Dáil and Seanad). As with other product regulations, it will also be subject to EU notification requirements, including a standstill period.
Current indications suggest that the measures contained in this legislation may not take effect until 2027, depending on the final content of the legislation and the implementation arrangements.
Ban on Disposable V**es - Public Health (Single-Use V**es) Bill 2025
The Public Health (Single-Use V**es) Bill 2025 is also moving through the Oireachtas and is expected to be enacted shortly.
This legislation will prohibit the sale of disposable va**ng products once it comes into force. A sell-through period of six months is expected following commencement of the legislation.
Retailer Engagement
As these legislative proposals continue to move through the parliamentary process, it is important that retailers are aware of the potential implications for their businesses.
Retailers may wish to consider contacting their local TDs and Senators to highlight how these proposals could affect local shops, retailers and customers. Hearing directly from retailers can help ensure policymakers understand the practical realities of retail operations.
Retailers may also wish to raise these issues through relevant retail industry representative bodies.
