CONDITIONS OF SALE
In these Conditions of Sale, “we” refers to Comhairle nan Eilean Siar and “you” refers to the buyer of the goods.
1. Description and Condition of Goods
The goods will be as described by us, and will be of satisfactory quality taking into account all relevant factors, especially their age and condition. Other than that, we make no statement, nor give
any warranty or guarantee, about the condition of the goods. We make no statement about the fitness of the goods for any particular purpose. No statements or representations from us will form part of the contract for the sale of the goods unless they are in writing. You are advised to make you own enquiries about the condition of the goods and their fitness for any particular purpose.
2. Payment and Collection
There shall be no binding contract for the sale of the goods until we have received payment in full for them. You may not collect the goods, nor will we deliver them to you, until we have received payment in full for them.
3. Ownership and Risk
Ownership of the goods will not pass to you until we receive payment in full for them and they are in your possession. The goods will be at our risk until they are in your possession.
4. Liability
We will not be liable to you for any loss or damage arising from the sale of the goods unless you suffer physical injury or death resulting from our negligence.
5. Your Rights
Nothing in these Conditions of Sale is intended to affect your statutory rights adversely as a consumer under the Consumer Rights Act 2015.
