🏥🏬How Real Estate Brokers Trick Their Clients Into Good Deals🏢🏪

This is a story about a smart lawyer and how he did not understand how the commercial real estate game is played.
**********************************************
At 2,000 square feet, the lawyer was a below average sized tenant, in an A class building in a financial core district. His landlord offered a golf trip every year for every broker that completed a deal with the landlord (the landlord had deep pockets).
**********************************************
That incentive program intensified the already-competitive commercial real estate brokerage market. The lawyer not only received many calls from real estate brokers who want to represent him, but the phone started ringing three years prior to his lease expiry.

To provide some context, the commission on the deal was going to be $10,000 if he renewed for 5 years. If two agents work as a team and work for a firm that provides a 50/50 split on commissions (industry norm), the agents would each make $2,500. The trip was typically a $5,000 value, and a lot of fun...a weekend away with your industry peers and some recognition that you belong in a club of elite corporate real estate rain makers.

There is no standard length for a commercial lease. In the past year, Lease Ref has seen a 110 page lease (that was fun to review), and 10 page lease.
**********************************************
In terms of word count, we have seen as high as 50,000 words and as low as 4,200 words. The average commercial lease we reviewed in the past year was at a word count of 22,248.
**********************************************
We have seen individual clauses such as a tenant improvement allowance clause, assignment and subletting clause, rights to renew and right of first offer clause each have over a full page.
**********************************************
As a general rule, a longer lease is usually better as that landlord has likely put more thought to all the potential scenarios that could come up, and it is good to be able to modify what is already on the page. However, most of the clauses are designed to protect the landlord so there will definitely be more work to be done before the lease is modified to be tenant-friendly.

The 80/20 rule applies to office leasing, in that 80% of the inventory is owned by 20% of the landlords. Retail is much more balanced.
**********************************************
While high end retail and malls are more of an oligopoly, that is balanced out by the vast amount of mom and pop retail stores that are at a lower purchase price point.
**********************************************
A lower price point means that independent landlords can compete to acquire those properties and the larger landlords are also typically uninterested in small buildings.
**********************************************
When the small, independent landlords have vacancies they tend to gravitate to the least expensive way to market their space by simply putting a sign on the building.
