To All Ebike Users❗️
Here are the correct and legal guidelines based on *RA 11697 (EVIDA) and current national rules:
1. PRIVATE E-BIKES DO NOT REQUIRE LTO REGISTRATION
Exactly according to EVIDA IRR:
> “Private-use light electric vehicles shall NOT be required to register with DOTr or LTO.”
Meaning:
❌ No plate
❌ No OR/CR
❌ No MV inspection
❌ No registration fee
❌ No driver's license (if basis is vehicle registration)
LTO cannot override this unless the law RA 11697 itself is amended (subukan niyong mag bend the law din)
2. LTO ANNOUNCEMENTS CANNOT CANCEL A NATIONAL LAW
Administrative orders cannot contradict a Republic Act. That's why LTO memos about e-bikes are repeatedly suspended.
3. BUT—ROAD ACCESS IS A DIFFERENT AUTHORITY
VERY IMPORTANT:
Even if e-bikes don’t need registration,
this does NOT mean they can be on all roads.
Road access is controlled by:
MMDA (Metro Manila)
LGUs (cities/municipalities)
National traffic laws (limited-access highways)
So:
✅Allowed – barangay roads, secondary roads, side streets
✅Allowed – bike lanes (if not prohibited by the LGU and what if there are no bike lanes? )
❌ Not allowed - expressways/tollways
❌ Not allowed in Metro Manila – national, radial, circumferential roads (MMDA Reg. 24-022)
This is not a conflict with EVIDA, because traffic rules are the basis, not "registration. "
4. YOU can be taken to impound if you enter the forbidden major road
Not because "there's no plate." ”
But because: “prohibited road for LEVs.”
The law is very clear:
Registration exemption ≠ unlimited road access.
5. What can the LTO NOT do?
❗️Can't demand a plate
❗️Not allowed to register
❗️Can't take OR/CR
❗️You cannot require a license *if the basis is vehicle registration*
❗️Can't catch an e-bike because it's "unregistered"
All of these are directly blocked by EVIDA.
6. What CAN MMDA / LGU do?
❗️Ban LEVs on specific roads
❗️Provide designated bike/LEV lanes
❗️Implement speed limits
❗️Impound if passing through the “prohibited road”
❗️Magpa-helmet ordinance (local ordinance)
This is legal, because they cover road safety and traffic authority.
7. SUMMARY (Most Clear)
LEGAL FACTS:
✅E-bikes are **registration-exempt** under RA 11697.
✅LTO cannot require plates, OR/CR, or license based on vehicle registration.
✅DOTr himself wrote the exemption.
✅BUT road access can still be restricted by MMDA/LGU for safety.
✅Provide bike lanes
✅Provide comprehensive guidelines about those "national roads"
✅Guidelines about those who should only drive
So:
👉 You can't be caught because "no plate. ”
👉 But you can get caught if you go through a road where e-bikes are forbidden.
