These terms and conditions together with those set out in Notice to Purchase on our platform are the only terms and conditions subject to which vmapac.com as agents for the vendors, will sell goods to the customer(s). All other terms and conditions, whether express or implied, as are capable of lawful exclusion are hereby excluded. VMA acts as agent at all times for the Ven
dor(s) in the sale and as such is not responsible for the Vendor(s)’ acts or omissions and/or acts or omissions undertaken by VMA on behalf of the Vendor(s). You are urged to read these terms and conditions thoroughly and make sure you understand its entirety prior to using our services. You are deemed to have agreed to be borne by these terms and conditions when placing your order. Eligibility to Purchase
You must be at least 18 years of age when placing your order, or under supervision of a parent or guardian if you are under 18 years of age. You will be asked to provide your personal details when you make purchase on our platform, including but not limited to your name, contact number, e-mail address and other particulars as indicated. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and confirm you are the actual person referred in the billing information provided. Furthermore, you are deemed to have agreed that we may use personal information provided by you in order to conduct appropriate anti-fraud checks, personal information that you provide may be disclosed to a credit reference or fraud agency when needed. When placing your order, please add items to your shopping cart, enter your billing/shipping address, select your delivery option and method of payment to complete your order. All orders are subject to acceptance and availability, we will not reserve items in your shopping cart and nor will guarantee the items in your shopping cart may be purchased by other customers. VMA ONLY offers products for sale that are already in stock and available for dispatch immediately from our own facility. Prices shown on our platform are in Hong Kong Dollars currency free of any taxes, customers purchasing from other countries may incur relevant import duty or VAT, this will be the sole responsibility to the purchaser and VMA will not be liable for this amount. All prices and offers remain valid as displayed except technological errors incurred, VMA reserves the right to change our prices in response to currency exchange rates and other commercial factors. However, all orders will be honoured at the time you place your orders. Customers with credit/debit cards not dominated in Hong Kong Dollar currency will need to depend on the final exchange rates calculated on the day of card issuing institutes process the transaction. Once your order has been placed, you will receive an acknowledgement via your registered email address. This is only a confirmation of receipt of your order and NOT an acceptance of your order. You will receive a confirmation (Acceptance of Order) within 24 hours after you placed your order and upon clearance of payment, the order is then Irrevocable and cannot be cancelled. We reserve the right not to process your order in the event of failing to obtain payment authorisation codes, shipping restrictions in certain countries or shipping of any particular items. Refund Policy
We offer a 14 days refund policy on all items unless otherwise specified, provided the items are unused, no damages, cosmetic marks and stains on the actual unit and its packaging, all packaging together with original authenticity cards, dust bags, tags and VMA refund tags remain and intact. You should contact [email protected] prior to sending your item(s) back for refund, this will allow us for easy identification and prompt processing. We have made every effort to display as accurately as possible the colours of the products, however, display monitors and resolution may vary and we cannot guarantee the accuracy and deviance of colours. You may not in any shape or form directly or indirectly modify, copy, distribute, transmit, publish, reproduce any contents from our platform without our prior written consent. You shall not transmit or distribute any known or unknown virus on our platform which is malicious, technologically harmful or in any way offensive or obscene. Any breach of this provision may result in constituting an offence under the applicable laws. VMA reserves the right to report of such act to the relevant law enforcement authorities and legal action will be taken. In the case of total loss and/or under destruction of any items prior to delivery, VMA may treat the contract in relation only to such item as frustrated and return to you any monies in relation thereto in full and final satisfaction of all claims by you in relation to the purchased items. If for any reason whatsoever, VMA fails to deliver the purchased item(s), or should any third party claim possession of or title to the purchased item(s) prior to delivery, VMA has the right to rescind the sale and VMA’s sole liability shall be the sum not exceeding the amount paid by you. These Terms and Conditions shall be governed by and shall be construed in accordance with Hong Kong SAR law, all transactions to which these conditions apply and all matters connected therewith shall also be governed by Hong Kong SAR law. VMA hereby submits to the non-exclusive jurisdiction of the Hong Kong SAR Courts and all other parties concerned hereby submit to the non-exclusive jurisdiction o the Hong Kong SAR Courts. In this Terms and Conditions and Notice to Purchase where the context so admits:
VMA shall include the servants/agents of VMA
The expression ‘purchaser’ ‘buyer’ or you shall mean the person who made the purchase on our platform
The expression ‘items’ shall mean the merchandise or goods to be sold on this platform. The expression ‘Vendor’ shall represent the owner of the items, and its subsidiaries acting as agent to the company without personal liability. Words imparting the singular number shall include the plural number and vice versa, and the headings to the clauses hereof are for convenience only and have no legal effect and shall not be taken into consideration on the interpretation or construction hereof.
